1.0. Introduction

This Privacy Policy applies to the services provided by Loyall AS (Simp) to the ("Customer"), (referred to collectively as "we", "us", and "our") in connection with the delivery of the ("Customer Club") and the collection of information, including but not limited to loyall.no, loyalty.simp.no, facebook.com/loyall.no, explaining how personal data is collected, used, and protected by Simp AS and the operators of the Customer Club. 

1.1. We will be open and transparent about how we process your personal information. Your personal information will only be processed for legitimate purposes and will be deleted, pseudonymized, or anonymized when we no longer have a basis for processing it. You will receive information about your privacy rights and how to enforce them. We will continue to develop services and solutions with privacy integrated into their design.

1.2. When you use our software, our website, or other digital services (hereinafter referred to as "the services"), we collect, process, and store your personal information. It is important for us to safeguard and protect this personal data in the best possible way to maintain its integrity. With this Privacy Policy, we will also inform you about how we process your personal information. 

2.0. Personal information

2.1. Processing of personal data when participating in the Customer Club and Bonus Program
Loyall AS provides and operates the bonus programs in which you are registered by consenting to these membership terms. As a member of the customer club you have chosen to join ("Customer Club"), Loyall AS aims to offer you personalized and relevant information about products and services, as well as benefits in the form of offers, gift cards, and purchase bonuses.

When joining the Customer Club, you are simultaneously registered in Loyall AS' bonus program, Loyall Bonus, which will provide you with benefits from providers associated with this bonus program. 

2.2. When you use our services as described in our terms of use and/or are in contact wish is, Loyall AS (Loyall) and the respective Customer Club will process your personal data. Below you will find information about the personal data that is collected, why we do this, and your rights related to the processing of personal data. 

2.3. As the same personal data is collected for participation in both the Customer Club and the bonus program Loyall Bonus ("Bonus Program"), both the owner of the Customer Club and Loyall AS are formally joint controllers, referred to as "Joint Controllers". This means that the owner of the Customer Club is the controller for the collection and use of personal data related to the Customer Club, while Loyall AS is the controller for the collection and use of personal data related to the Bonus Program. Loyall AS is also, according to its own data processing agreement with the owner of the Customer Club, a data processor for the latter. 

2.4. As a natural consequence of the above and to facilitate your communication, Loyall and the owner of the Customer Club have decided that Loyall AS will be the joint point of contact for your inquiries regarding this Privacy Policy and the use of your personal data. Loyall AS handles your inquiries and involves the owner of the Customer Club to the extent necessary. However, you can always choose to contact the owner of the Customer Club directly. Contact information for the owner of the Customer Club is provided in the information about the Customer Club. 

2.5. When this Privacy Policy uses the terms "we" and "our", this refers to both Loyall AS and the owner of the Customer Club unless otherwise indicated in context. The join point of contact for the joint controllers of the personal data we process is Loyall AS.

3.0. Why we collect personal data and what kind of information we collect

We collect your personal data in order to provide our services related to the Customer Club and Bonus Program as described in the Terms & Conditions. The processing is therefore carried out in accordance with our agreement with you.

3.1. Upon registering in the Customer Club and Bonus program, we collect information such as name, home address, and date of birth. Additionally, information about debit cards/credit cards is also registered. Purchase data collected includes information such as amount paid, products, date of purchase, seller, and where the purchase was made. This information may be linked with information from external sources (number lookups, address registries, etc.) used to enrich and maintain your member profile in the Customer Club and Bonus Program. 

3.2. Your member information is also used for analysis purposes and as a basis for sending relevant member offers and information via SMS, email, addressed mail, or other communication channels, provided you have consented to such communication. The information is also used to respond to inquiries from you. 

4.0. Disclosure of personal data to others

As a member, you have consented to the owner of the Customer Club, Loyall, and Loyall's subcontractors (such as distribution companies, media agencies, and technical providers) using the information from the registration, as well as purchase and bonus information, for analysis and communication purposes. As mentioned before, Loyall and the owner of the Customer Club are joint controllers for your personal data. Subcontractors are used for the technical part of the data processing. An overview of subcontractors can be provided upon request to Loyall AS, Øvre Ole Bulls Plass 1, 5012, Bergen, Norway. All processing of personal data that we carry out takes place in the EU/EEA area. 

4.1 Loyall and the owner of the Customer Club have ensured the security of your information at all stages of the data processing through agreements.

5.0. Storage period

We store your personal data for as long as necessary for the purpose for which the personal data was collected. 

5.1 Personal data will be stored for as long as you are a member of the Customer Club and Bonus Program, and will then be anonymized or deleted. However, certain information, such as transaction history, will be retained in accordance with the accounting obligations under the Accounting Act (Regnskapsloven), in accordance with the law's retention requirements. 

6.0. Security

Multiple forms of security technology are used to ensure good protection against unauthorized access and misuse of your personal data.

7.0. Your rights when we process your personal data

You have the right to request access, correction, or deletion of the personal data processed by us. Furthermore, you have the right to request restriction of processing, object to the processing, and request data portability. 7.1. To exercise your rights, you must contact support via the Website. We will respond to your inquiry as soon as possible and no later than 30 days. You can withdraw your consent for the processing of personal data by contacting support via the Website. 

8.0. Complaints

If you believe that our processing of your personal data does not comply with what we have described here or that we are otherwise in violation of privacy legislation, you have the right to lodge a complaint with the Norwegian Data Protection Authority. 9.0. Changes

If changes are made to our services or the regulations regarding the processing of personal data, it may result in changes to the information provided in this Privacy Policy. If we have your contact information, we will notify you of these changes. Otherwise, updated information will always be readily available on our website.

When you use the service and visit websites related to your use of the Bonus Program, we collect certain information using cookies. 11.0. Personalization of Profile/Profiling

We may also process your personal data by collecting the information in your customer/user profile and your purchase history when using the Services. This will enable us to provide you with even more relevant and targeted communication, information, and marketing via email, SMS, and other channels. This will enhance user-friendliness and make our communication with you more tailored and relevant to your preferences, desires, and needs. In this way, we avoid sharing irrelevant information with you. 

11.1. The purpose of this processing is to simplify the use for you and the administration for us, while allowing us to provide you with more relevant and tailored information according to your own preferences. We believe that this will be in line with both your and our legitimate interests and for certain information necessary to manage the customer and user relationship in accordance with our terms of use. 

11.2. You will at any time be able to opt-out or object to our processing in the form of collecting information stored in your customer- and user profile. If desired, you can easily modify or delete parts of your profile, or the profile in its entirety. 

12.0. Transfer of personal data

We may share personal information in the event of acquisitions, mergers, or sales of all or a significant part of our business, with or to another company. In such cases, a member will receive electronic notification if user data is subject to a Privacy Policy which is substantially different from his one. 

12.1. We may transfer aggregated data to our authorized third parties (domestic/foreign) to improve or develop our Services or to ensure satisfactory functioning of the Services. Transfer of personal data to a third country outside the EEA which does not provide adequate data protection will not occur. 

13.0. Changes to this Privacy Policy

We reserve the right, without notice, to update or change this Privacy Policy to account for changes in our services and business models, as well as new or different privacy practices. An updated Privacy Policy will then be made available on our website. We ask that you stay informed about the current Privacy Policy. These changes will become effective on the "last updated" date in the revised edition. A member accepts the revised edition by continuing to use the Service. If you do not accept the changes, you must cease using the Services, or, if necessary, adjust or delete the information from your profile.
