1.0. Parties to the Agreement and content

Loyall AS (the Company) provides and operates the loyalty programs in which you are enrolled upon consenting to these membership terms. As a member of the "Customer Club", Loyall AS aims to offer you, the member, personalized and relevant information about products and services, in addition to benefits in the form of offers, gift cards, and purchase bonuses. Upon joining the "Customer Club", you are simultaneously enrolled in Loyall AS' loyalty program, Loyall Friends (the "Bonus Program"), which will provide you with benefits from providers associated with this Bonus Program. The Customer Club and Bonus Program will hereinafter be collectively referred to as the "Bonus Programs". 

2.0. User Account

Registration in the Bonus Programs requires the Member to be an individual over 16 years of age, to identify themselves by providing an email address and mobile number, and to accept the Terms of Use. It is not permitted to create more than one user account per person. The Member is obligated to ensure that the registered information is always true and complete during registration and when using the Bonus Programs. As a user of the Bonus Programs, the Member is solely responsible for all activity and transactions associated with their user account. The Member can terminate their user account at any time by contacting support on the Website. The Company reserves the right to modify or delete content, delete the Member's user account, and/or deny the Member access to the Bonus Programs if the Member does not comply with the guidelines in this Agreement. 

3.0. Earning and calculation of Bonus

Bonus points are earned through transactions made with registered debit cards (account number) and registered Visa and MasterCard cards on the Member's user account with providers affiliated with the Bonus Programs. Deviations may occur, and the Member may be notified of such deviations by email and/or on the Bonus Programs' websites. Payments made using other means of payment, such as cash payments, do not generate bonus points. Other means of payment may be integrated as bonus-generating in the future. The Customer Club shall not be used for trading large volumes for resale or in commercial activities. If one or more online stores are part of the Bonus Programs, bonus points may be earned by using the same mobile number and email address during purchases in the online store as the ones that are registered on the Member's user account in the Bonus Programs. Bonus points are calculated as a percentage of the purchase amount. The Provider and/or program owner may increase or decrease the bonus percentage during certain periods, timeframes, and/or for different products. An overview of a Member's available bonus points is found on the Bonus Programs' websites. The Company reserves the right to correct a Member's bonus balance in case of errors and/or miscalculations. The right to correction applies even if the bonus points have been redeemed before the error was discovered. Wrongfully earned and redeemed bonus points may result in a claim against the Member if the correction results in a negative bonus balance. 

4.0. BonusID and registration of payment cards

Loyall AS is the systems and operational provider of the Bonus Programs and receives transaction data from various transaction sources. When participating in the Bonus Programs, a BonusID is created by Loyall. For security reasons, all account numbers and payment cards are linked to a personal BonusID. The personal nature of the BonusID means that only account numbers and payment cards which are legally owned by the Member may be registered on the Member's BonusID. It is not permitted to register account numbers and/or payment cards belonging to another person or entity. The payment cards registered by the Member will be added to the Member's BonusID. If the Member already has a BonusID, the data associated with said BonusID will be added to the Member's profile in the Bonus Programs. Transactions made by the Member with a provider integrated with Loyall AS' system platform will be linked to the Member's BonusID. Loyall AS may communicate with the Member regarding transactions, bonus points, support, and other matters related to the Member's BonusID. 

5.0. Overview of earned/available Bonus points

The Member may find an overview of their available bonus points by logging in on the Bonus Programs' websites. The member pages contain an overview of the customer relationship, including the Member's profile, bonus points, and receipts.

6.0. Redeeming Bonus points

‍The Member may only redeem bonus points when purchasing goods or services in chains/stores where bonus points have been earned. Bonus points may not be withdrawn in the form of cash or transferred to a bank account. When redeeming the bonus points, the Member is free to choose whether to spend some or all of their bonus points. A smartphone is required to redeem bonus points. Triggered bonus points on the smartphone will immediately appear as a bonus voucher. The bonus voucher will either display a barcode to be scanned by store staff or serve as a discount coupon. If the bonus voucher appears as a discount coupon, the redeemed bonus amount should be manually deducted as a discount at the cash register by store staff. Members also have the option to receive SMS notifications with information about their own bonus balance or similar. 

7.0. Validity of bonus points

Bonus points are valid for the year in which they were earned and the following calendar year, unless otherwise specified on the Bonus Program's website regarding the validity period of bonus points. 

8.0. Processing of Personal data

All processing of Personal data is done in accordance with the Personal Data Processing Act (lov om behandling av personopplysninger) and guidelines provided by the Norwegian Data Protection Authority. Please refer to our Privacy Policy for more information on how the processing is conducted. 

9.0. Changes

In order to maintain the quality and improve the Service, changes may be made to the Services available in the Bonus Programs at any given time. The terms of use may be modified, including the introduction of new rules, terms, or conditions for the Bonus Programs if deemed necessary for the further development of the Bonus Programs. If the changes are significant for the Member, the Member will be informed about them. The current membership terms are always available on the Bonus Programs' website. 

10.0 Disclaimer

‍The Company is committed to providing as accurate information as possible about the Bonus Programs, and efforts will be made to ensure the accuracy of available data. However, the Company does not assume responsibility for any errors, omissions, or inaccuracies in the information provided. The Company is not liable for any damages or losses resulting from the content on the Bonus Program's website. The Company is not responsible for direct or indirect damages, lost profits, or any other losses resulting from errors, incorrect display or presentation, or complete absence of information published in the application due to errors on our part or other factors. This also applies when the application service is temporarily or permanently unavailable, regardless of whether it is due to technical reasons or such as data system issues, network connections, GPS accuracy, device errors, or other factors. The Company cannot be held responsible for the content, materials, functionality, or any other aspects of third-party websites linked from the Bonus Program's website. 

11.0. Force Majeure

In the event of circumstances that make it wholly or partially impossible to allocate/redeem bonus points or purchase products/services, the obligation ceases for as long as the circumstances persist. Such circumstances include, but are not limited to, strikes, lockouts, and any other event that, according to Norwegian law, would be considered force majeure. 

12.0. Termination of membership

Termination of membership in the Bonus Programs is done by contacting support on the Bonus Program's website. Upon completion of the termination, any unused bonus points belonging to the Member will be deleted, and the accumulation of bonus points will cease. 

13.0. Violation of membership terms, abuse, and default

‍In the event of a violation of the membership terms, abuse of bonus points, or any other default, the membership may be terminated with immediate effect. Abuse of bonus points may result in reporting to the authorities and a demand for compensation.

14.0. Change of Address

The Member is obligated to report changes in name, address, updated/new payment cards, and other information. This is done by updating the profile information/card details on the Bonus Program's website. 

15.0. Complaints

In the event of complaints regarding bonus point calculation, the applicable purchase receipts should be presented.

16.0. Public fees

The Member is solely responsible fro any fees resulting from or related to the use of bonus points, for example when points are earned in connection to business trips paid for by an employer. The Company disclaims all liability regarding tax and fee obligations imposed on the Member in connection with the use of bonus points.
